congratulations to the 2021 raffle winners

The Bellbrook Athletic Boosters (“The Athletic Boosters”), a 501(c)(3) charitable organization, is sponsoring a fundraiser known as The Car Raffle ("Raffle"). All net proceeds of the raffle will benefit the athletic department of the Bellbrook Sugarcreek School District and will go to participating groups/organizations. Rules and regulations of the Raffle are set forth below. By purchasing a raffle ticket ("Ticket"), each eligible person (“participant”) represents that they meet the eligibility requirements below, and agrees to be bound by the rules, terms, and conditions, all applicable laws, ordinances, and regulations, and by the decisions of the Athletic Boosters or its authorized representative(s).  

Eligibility:

The Raffle is only open to residents of the State of Ohio, who are 18 years of age or older as of the date of the drawing. All federal, state and local laws and regulations apply. Void where prohibited by law. The Bellbrook Athletic Booster board members and immediate family members are not eligible.

To Enter:

The Athletic Boosters will sell Tickets at various home Bellbrook Athletics sporting events, including all home football games, at a cost of fifty dollars ($50.00) per Ticket. The Athletic Boosters reserves the right to void any Ticket purchase submitted with payment that does not constitute "good funds" or that is otherwise non-compliant with the Official Rules. There is no limit to the number of tickets that a single person may purchase. Tickets will be sold beginning on August 27, 2021, through the start of the Bellbrook home football game vs. Valley View High School on October 22, 2021. All purchases must be made during the raffle period. For each ticket purchased, the purchaser will be issued one raffle ticket and a duplicate ticket. The purchaser is responsible for providing the name of only one eligible individual per ticket and the contact information to be used in the event the ticket is drawn. The purchaser will deposit their ticket in the raffle barrel. The Athletic Boosters, its agents, and representatives, are not responsible for any lost, late, misdirected, incomplete, illegible, undelivered, or destroyed raffle tickets regardless of cause or the person responsible. No refunds will be made except as otherwise determined by the Athletic Boosters in its sole discretion. It is not necessary for the winner to be present to win. Participants must follow all instructions and submit a complete ticket entry form to be qualified to win the Raffle. 

Odds: 

The odds of winning the Grand Prize are 1 in 3,000.

Prize Drawing: 

Following the close of the raffle period at Bellbrook Football home game vs. Valley View High School on October 22, 2021, a winning ticket will be selected by random drawing from among all Tickets purchased during the raffle period. All drawings will be conducted by Athletic Boosters, whose decision is final and binding. A Second Prize drawing will be held first (“Second Place Winner”); a First Prize drawing will be held second (“First Place Winner”); and a Grand Prize drawing will be held last (“Grand Prize Winner”). All Prize Claimants have thirty (30) days to claim their prize. A Winning Ticket is the only valid receipt for claiming the Prize. The Prize Claimant must provide the Athletic Boosters with all information required to claim the Prize (including any information necessary to determine eligibility requirements and tax identification information). In the event the Prize Claimant (a) does not acknowledge the Athletic Boosters’ attempts to contact; (b) is ruled ineligible for any reason; or (c) refuses further participation, the Prize Claimant will have been deemed to forfeit their Prize.

Prize: 

All prizes are given subject to the respective winner’s eligibility and compliance with these Rules. If 1,501 tickets or more are sold, the Winner of the "Grand Prize" will receive a 2021 GMC Canyon Denali (or, an alternate Grand Prize described herein) provided by SVG Autos and The Bellbrook Athletic Boosters. If 1,500 tickets or less are sold, the Winner of the Grand Prize will receive fifty percent (50%) of the net proceeds (total collected by the Athletic Boosters minus any related expenses from the Raffle sales) for the raffle period, or any other pre-determined guaranteed, minimum payout announced by the Boosters for the Raffle. There will be no "first prize" or "second prize" if 1500 tickets or less are sold.

• If the Grand Prize Winner is awarded the 2021 GMC Canyon Denali], the Grand Prize Winner may elect to accept an alternate Grand Prize, being one of the following options: (a) $30,000.00 to put towards another available vehicle of their choosing at SVG Motors, or (b) a cash prize of $30,000.00. 
• The Grand Prize Winner agrees to assume and pay all taxes, fees and charges, including but not limited to license, title, and registration fees; Local, state and federal taxes, including taxes on gambling winnings, which must be paid prior to the transfer of the vehicle; expenses related to the damage or loss to persons or property as a result of the lease not covered by insurance; and any other costs or expenses related to the Prize. 
• The Athletic Boosters shall be responsible for notifying SVG Motors of the identity of the Grand Prize Winner and providing pertinent contact information. The Athletic Boosters shall not be responsible for ensuring the execution or delivery of the Prize. 
• The Grand Prize Winner agrees to accept the Grand Prize “AS IS,” with no warranty guarantee, either express or implied by The Athletic Boosters, except as specifically provided by SVG Motors or the vehicles manufacturer.  
• If the Grand Prize consists of the 2021 GMC Canyon Denali or another alternate vehicle, the Prize transfer will occur at SVG Motors in Beavercreek, Ohio. 

The First Place Winner will be given $1,000.00 cash. The Second Place Winner will be given $500.00 cash. All Winners must claim their Prize within thirty (30) days of notification. Otherwise, such Prize will be awarded in succession to the first and then subsequent alternates, as drawn at the Raffle drawing. The Prize is not transferable.

All Prizes shall be reported to the Internal Revenue Service (IRS) pursuant to IRS Publication Numbers 1340 and 1335. All Winners must complete Forms W-2G, W-9, and 5754, as necessary, prior to receiving their prize(s). Winners will be provided copies of all completed form(s) pertaining to their prize(s). The Winner must pay to the Athletic Boosters twenty-five percent (25%) of the fair market value of the prize minus the amount of the wager, the amount of which will be withheld and paid to the IRS.

Taxes:

Each Participant acknowledges that amounts paid for Raffle Tickets are not gifts to the charitable organization and do not qualify as deductible charitable contributions. The Winner is responsible for any and all federal, state, and local taxes, fees, and other government assessments on the awarded Prize. Furthermore, the Athletic Boosters is not required to withhold or collect on certain prize values upon award or distribution. Federal and state withholding laws are subject to change with or without notice. The withholding laws in effect at the time of award will be followed. The Athletic Boosters assumes no responsibility for the Winner's tax and/or legal obligations, including the payment of taxes, and suggests the Winner consult his/her tax and/or legal advisor.

General Terms:

By entering the Raffle, the participant agrees that his/her name and/or likeness may be disclosed to and used by the news media, SVG Motors and/or The Bellbrook Athletic Boosters for promotional purposes without additional compensation. In addition, each participant releases the corporate entities of The Bellbrook Athletic Boosters, SVG Motors and their respective parent or affiliated companies, directors, officers, employees, volunteers, and agents from any and all liability for injuries, losses, or damages of any kind caused by participating in the Raffle or winning the Prizes, or resulting from acceptance, possession, use or misuse of the Prizes. The Winners and/or their family, heirs, associates or other interested parties agree to indemnify and hold harmless the corporate entities of The Athletic Boosters, SVG Autos, and their respective parent or affiliated companies, directors, officers, employees, volunteers, and agents from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the Winner's acceptance or use of the Prize(s). 

All Ticket sales are final. A participant's sole and exclusive remedy for the Athletic Boosters breach shall be limited to the return of the purchase price paid for his/her Ticket(s). In no event shall the corporate entities for The Athletic Boosters, SVG Autos, and their respective directors, officers, employees, and volunteers be liable to any party for any loss or injuries to earnings, profits, or goodwill, for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages by counsel. 

Tickets shall not be resold to any other party. Any Ticket which has been resold shall be void. All individuals who re-sell, purchase, or receive a Ticket in violation of these Rules shall be ineligible to participate in the Raffle or to win the Prize. By purchasing a ticket and choosing to participate in the Raffle, each Raffle participant acknowledges and agrees that The Athletic Boosters has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason, and in such event, a participant's sole and exclusive remedy shall be to receive a refund of the full price paid by such participant for each Raffle ticket purchased, without interest.
